WorldMadeChannel B.V., the producer of the WorldMadeChannel television channel featuring exclusively home pictures/movies, seeks submission by people all round the world of their home videos and photos shot with a consumer camera for possible broadcast in TV programs and invites you to become an Entrant to the WorldMadeChannel Project.

RULES OF ENTRANCE TO THE «WorldMadeChannel» PROJECT
«WorldMadeChannel B.V.» . reserves the right to amend these Rules at any time.


       1. Any person from any country of the world can become an Entrant to the WorldMadeChannel Project (hereinafter referred to as “the Entrant”), who:
•  entirely and unconditionally accepts these Rules of Entrance to the WorldMadeChannel Project (hereinafter referred to as “the Rules”);
•  submits to «WorldMadeChannel B.V.» for using in the «WorldMadeChannel» Project his/her home videos and photos (hereinafter referred to as “the Materials”). «WorldMadeChannel» will accept an unlimited quantity of Materials from each Entrant;
•  submits to «WorldMadeChannel B.V.» the filled out and signed Form of an Entrant to the «WorldMadeChannel». Project. The signed Form of an Entrant and materials can be sent over the Internet or by post.

       2. Upon submission of his/her Materials to the «WorldMadeChannel B.V.» address, the Entrant declares and warrants the following:
- I understand and agree that all Materials shall become the sole property of «WorldMadeChannel B.V.».
- I warrant that the submitted Materials are solely my original work.
- I warrant that I am a rightful owner of the submitted Materials and I have all rights and authorities to submit the Materials for using in the «WorldMadeChannel» Project under these Rules.
- I declare and warrant that all identifiable persons (and/or their legal representatives) depicted in my Materials have granted to me the CONSENT in writing for entering the «WorldMadeChannel» Project executed in the following form: “I do hereby consent to the possible broadcast of videos and/or photos in which I am depicted in the WorldMadeChannel TV programs, in any «WorldMadeChannel», projects and/or in any other program, and/or to any ancillary use in any mass media, including advertisements and announcements in all countries of the world. This consent is my express waiver of defamation, libel or any privacy claims, as well as my express waiver of any right to remuneration”. (A CONSENT is unnecessary if a person is a part of a crowd scene or shown in a fleeting background).
- I assign in general to «WorldMadeChannel B.V.» the rights to use the Materials submitted by me in any form and in any manner, including, without limitation, rights to publication, communication to the public and reproduction in any form, including advertising and announcements, during the entire term of copyright and neighbouring rights stipulated by the laws in the territory of the rights’ execution for use all over the world, and, further, I abandon in whole the right to remuneration.
- I grant to «WorldMadeChannel B.V.» the right to repeatedly use the submitted Materials with or without mentioning my name in any project of «WorldMadeChannel» and/or in any other program, and/or for ancillary use in any mass media, including advertisements and announcements, at its own discretion.
- I grant to «WorldMadeChannel B.V.» the right to select the submitted Materials for their use under these Rules and/or to destroy them.
- I grant to «WorldMadeChannel B.V.» the right to edit and/or alter any submitted Materials.
- I grant to «WorldMadeChannel B.V.» the right to transfer the Materials submitted by me under these Rules and the rights to use them to any third parties.
- I guarantee that the submission of my Materials and granting rights to use them to «WorldMadeChannel B.V.» do not affect or infringe on any third party's copyright and/or neighbouring rights, as well as any other property and/or non-property rights.
- I guarantee that the events depicted in my Materials are in fact spontaneous and not staged.
- I guarantee to release, discharge, and hold harmless «WorldMadeChannel B.V.», its respective parent, subsidiary and affiliated companies, licensees, and assigns, and their respective officers, directors, employees, agents and representatives from any claim or liability arising out the use of the Materials submitted by me.
- I agree that «WorldMadeChannel B.V.» . is not responsible for any error, omission, interruption, delay, deletion or defect with respect to the transmission and/or broadcast of any program including, without limitation, any local, regional or national preemption (whether partial or total).
- I agree that «WorldMadeChannel B.V.» is not responsible for lost, damaged or misdirected Materials under any circumstances.
- I understand and agree that «WorldMadeChannel B.V.» NOT RETURN the Materials to me.
- I agree that my submission of Materials under these Rules shall be governed by and construed under and in accordance with the laws of the Netherlands applicable to contracts entered into and wholly performed therein. I consent and agree to the exclusive jurisdiction of the District Court of Amsterdam (the Netherlands).


       3. The Entrant and «WorldMadeChannel B.V.» clearly understand and admit that «WorldMadeChannel B.V.» accepts the Materials submitted by the Entrant for their use in the Project, relying on the unconditional validity and truthfulness of declarations and warranties given by the Entrant in item 2 of these Rules, and on these grounds «WorldMadeChannel B.V.» is released from any liability if any of the statements specified therein are unfaithful, false or erroneous in whole or in part.
